Founded in 2021, Corinne Hershkovitch’s firm specialises in art and cultural property law. This sector encompasses several areas of expertise, in particular those relating to cultural goods, their provenance and location, and their circulation on the market. It includes intellectual property law, contract law, criminal law and administrative law. The diversity of backgrounds and skills of the members of the team, who have a wealth of experience in both litigation and consultancy, means that they have total mastery of all these areas. In addition, they have in-depth knowledge of the art market and its players (artists, collectors, museums, dealers, intermediaries), a thorough understanding of the legal rules applicable to cultural goods and a high degree of international mobility, are as many assets on which Corinne Herskovitch’s firm relies on to assist the clients.

Cases are handled directly by Corinne Hershkovitch and her team in close collaboration with the client. The fees and terms of engagement of the firm are discussed and agreed upon with the client at the outset of the case. They are based on the rules in force within the Paris Bar and the needs expressed by the client.

International

Corinne Hershkovitch’s firm also boasts solid expertise at the international level. This international dimension is indeed crucial given the transnational nature of the art market, particularly regarding issues related to the relocation of cultural goods. This expertise is based on an in-depth knowledge of international conventions and the case law based on these conventions. Corinne Hershkovitch is also a member of the working group formed within the International Institute for the Unification of Private Law (UNIDROIT) to work on orphan objects.

Provenance research and the art market

It has become a requirement for all those involved in the art market to take the necessary steps when acquiring a cultural object to ensure that it has a clear provenance. Indeed, the traceability of a cultural object remains the best way of ensuring its legality, especially when it is bought or sold. Provenance research is one way of meeting the obligation to carry out the due diligence required when acquiring a work of art. With this in mind, and in response to growing client demand, Corinne Hershkovitch’s firm places great emphasis on provenance research. It is involved in various training courses and participates in the publication of articles and books relating to provenance research, and has recruited an employee-doctor under the CIFRE (Conventions Industrielles de Formation par la Recherche) scheme, enrolled at the doctoral school of the École des Hautes Études en Sciences Sociales (EHESS) to write a thesis on the legal, ethical and deontological aspects of provenance research.)
